1. Introduction

Welcome to Timbra. These Terms of Service (“Terms”) govern your use of the Timbra application and services (“Service”) provided by Timbra Sociedade Unipessoal (“we”, “us”, or “our”), a company operating in the European Union.

2. The Service

Timbra is an AI-powered service that converts written documents into chaptered audiobooks. By uploading a document, you instruct our systems to process its text and generate a synthetic audio equivalent.

3. User Content and Intellectual Property

You own your content. We claim no intellectual property rights over the documents you upload or the audio generated from them. You grant us a limited, temporary license to process your documents solely for the purpose of generating your requested audio.

Your Responsibilities: You represent and warrant that you hold the necessary rights, permissions, or licenses to the documents you upload. You agree not to upload materials that infringe third-party copyrights or violate any applicable laws. We reserve the right to remove or refuse to process any content that we believe violates these Terms, including under the EU Digital Services Act (DSA).

4. Acceptable Use

You agree not to use the Service to:

  • Generate hate speech, defamatory material, or illegal content (including CSAM).
  • Bypass or attempt to circumvent our fair use limits or rate limiting.
  • Use the service in any way that violates the EU AI Act or other applicable regulations.

5. Payments, Subscriptions, and Right of Withdrawal

We offer pay-as-you-go credits and subscription plans. Payments are processed securely via Stripe.

EU 14-Day Right of Withdrawal: As a consumer in the EU, you have the right to withdraw from a subscription within 14 days of purchase without giving any reason. However, if you expressly request us to begin the performance of the service (e.g., by uploading a document and consuming credits) before the withdrawal period expires, you acknowledge that you will lose your right of withdrawal once the service has been fully performed, or you will be charged a proportionate amount for what has been provided up to the time of withdrawal.

6. Fair Use on Local and Cloud Compute

Our service utilizes a mix of cloud infrastructure and our own private EU-based cluster. Processing times may vary based on load. We enforce fair use limits to ensure quality of service for all users.

7. Disclaimers and Limitations of Liability

The Service is provided “AS IS”. We do not guarantee that the AI parsing or synthesis will be error-free. To the maximum extent permitted by EU law, Timbra Sociedade Unipessoal shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service.

8. Changes to Terms

We may update these Terms from time to time. We will notify you of any material changes by posting the new Terms on this page and updating the “Last Updated” date.
